Law Enforcement Agencies: Collaboration

C3P is committed to strengthening our relationships with police services across Canada. To this end, we are establishing formalized protocols with Canadian police services. The purpose of these collaborations is to create consistency between our two agencies and to collaborate in order to reduce child victimization.

A. Purpose of LEA Website

The purpose of the LEA Website is to further the Canadian Centre for Child Protection Inc.’s (“C3P”) mandate of protecting children by providing content that may be of assistance to law enforcement officers working in the areas of child sexual exploitation and missing children (the “Purpose”).

B. Intended Users – Law Enforcement Only

The LEA Website is intended for access and use only by individuals employed by a law enforcement agency in Canada. If you are not employed by a law enforcement agency in Canada, do not access the LEA Website.

C. LEA Website & Enforcement

The LEA Website includes all content accessible within the “Law Enforcement Agencies” frame, including within the “Overview”, “Services & Resources to Support Law Enforcement”, “Research & Initiatives”, “Collaboration” and “Contact” tabs, and any other tabs which may be added from time to time. The LEA Website displays content and makes available downloadable resources (the “Downloadable Resources”), including the Internet Safety PowerPoint presentations available from the “Services & Resources to Support Law Enforcement – School & Youth Officer Resources” tab (the “Presentations”), created by C3P or made available by C3P with permission from the author/owner of the resource. For greater certainty, the term “LEA Website” includes all content displayed thereon, all Downloadable Resources and the Presentations, unless otherwise specified in the provision.

If you do not agree with the Standard Terms or the LEA Terms, do not use the LEA Website. If you are dissatisfied with the LEA Website, your sole remedy is to discontinue use of it. You acknowledge, by your use of the LEA Website, that your use is at your sole risk.

D. License, Permitted Use, and Restrictions

Use of the LEA Website is subject to the terms and conditions that follow.

  1. Ownership and License. The LEA Website is owned by C3P (unless otherwise indicated), is licensed at no cost, and is licensed “as is”. The LEA Website is not sold, given, or loaned. No ownership rights are granted, and this is not an agreement to assign any intellectual property or other rights. By clicking “I agree” when you access the site, you are agreeing that the terms of the license as set out herein are legally binding on you and the entity that employs you.
  2. No Posting Online; No Sale. The LEA Website (and any portion thereof) must not be sold, offered for sale, used for a commercial purpose, made available online, or made available through any content network that is accessible to the public.
  3. Permitted Use of Website. You may temporarily access, read, use, and download one copy of the LEA Website on any single computer for use in your role as an employee of a law enforcement agency, and use any content available thereon in accordance with sections 4–7 below.
  4. Permitted Use, Copying, and Distribution of Downloadable Resources. For the rules regarding use, copying, and download of a Downloadable Resource, refer to the small print generally found on the first few or last few pages (for larger resources) or at the bottom of the resource. Where details of permitted use and copying are specified on the Downloadable Resource, you agree to limit your use and copying to that permitted thereon. In general, and in cases where the Downloadable Resource does not specify details of permitted use and copying, you are authorized to print/reproduce a reasonable number of copies for use in your role as an employee of a law enforcement agency and to distribute such copies to members of the public that you serve.
  5. Permitted Use, Copying, and Distribution of the Presentations. You understand that the Presentations include original content of C3P as well as content owned by third parties, and C3P is required to ensure the rights of all such third parties are not violated. By these terms, the Presentations are licensed to the law enforcement agency within Canada that employs you, for the use of individuals employed by such law enforcement agency, and solely for the purpose of educating school-aged children or parents/guardians, as appropriate to the Presentation, about the subject matter of the Presentation, which typically consists of topics related to the personal safety of children (the “Presentations’ Purpose”). To facilitate the Presentations’ Purpose, electronic copies of each Presentation may be downloaded and then distributed to other individuals employed by the same law enforcement agency that employs the user and to individuals employed by a school at which the Presentations are to be given for the sole purpose of approving the Presentations before they are delivered.
  6. No Modifications Permitted. No part of the LEA Website may be modified. Examples of prohibited actions include removing, adding, moving, or editing content, including the removal of trademark, copyright, or other proprietary notices. If modifications are desired, contact C3P. Modifications are solely at the discretion of C3P, acting reasonably.
  7. Other Restrictions. You may NOT (1) share the link to the LEA Website with anyone who is not employed by a law enforcement agency within Canada; (2) create derivative works, copy, publish, reproduce, rent, sublicence, publish, modify, reverse engineer, decompile, transfer, translate, or resell for profit copies of the LEA Website, or any portion thereof, in any form or by any means whatsoever, be they physical, electronic or otherwise; (3) do anything to harm the functioning or content of the LEA Website; (4) permit, allow, or do anything that would infringe or otherwise prejudice the proprietary rights of C3P or allow any third party to access the LEA Website; or (6) redeliver any of the LEA Website using "framing", hyperlinks, or other technology without express written permission.

E. Disclaimer

The LEA Website is provided “as is”. C3P disclaims all representations, warranties, guarantees and conditions, whether express, implied, or statutory, including, but not limited to: any implied warranties or conditions of merchantability; fitness for a particular purpose; title; non-infringement of third party rights; error free or uninterrupted access; accuracy; availability; reliability; security; privacy; timeliness; legality; suitability; quality; currency or completeness.

F. Limitation of Liability and Remedies

C3P shall not be liable for any direct, indirect, special, consequential, incidental, economic, or punitive loss or damage, whether reasonably foreseeable or not, and whether based in tort, contract, or any other theory of liability, arising directly or indirectly from (1) the Standard Terms or the LEA Terms; (2) your access to or use of the LEA Website, or any of the Downloadable Resources or Presentations; or (3) your use of links to other websites. If the exclusion of liability is held to be unenforceable then C3P’s aggregate liability shall not exceed one hundred Canadian dollars ($100.00 CDN), regardless of how the loss or damage arose, the type or extent of loss or damage, and whether the loss or damage is based in tort, contract, or any other theory of liability. It is agreed that this section is fundamental to this license, as C3P is a registered charity and it would not be economically possible to operate and provide access to the LEA Website, the Downloadable Resources, or the Presentations without the liability exclusion contained in this section.

G. Indemnity

You shall indemnify, save harmless and defend C3P and its officers, directors, employees, agents, and contractors from any and all third party claims, demands, damages, actions, suits, liabilities, costs, expenses, and losses of any kind (including legal fees) on account of damages or losses to persons or property arising from a breach or alleged breach of the Standard Terms or the LEA Terms, or the use of all or any part the LEA Website, or any of the Downloadable Resources or Presentations in a manner that is not authorized by the Standard Terms, the LEA Terms, or (for Downloadable Resources only) the terms set out in small print generally found on the first few or last few pages of the resource.

H. Accuracy

The LEA Website is provided for educational and informational purposes only and should not be interpreted as a recommendation for any specific product or service, use or course of action. The LEA Website is not intended to be used as a substitute of any kind for legal or professional advice. The information on the Website is believed to be reliable when posted. Although reasonable efforts are used to ensure that the Website will be current and will contain no errors or inaccuracies, C3P cannot guarantee that the Website is accurate or error-free or that it will be current at all times. The information on the Website is subject to change without notice.

I. Relationship of the Parties

It is not the intent of the parties by the LEA Terms or by the LEA Website to create a partnership, joint venture, master-servant, principal-agent, or other relationship. Neither party may be held liable for any act of omission or commission of the other party, and neither party is authorized to nor has the power to obligate the other party by contract, agreement, warranty, representation, or otherwise in any manner whatsoever except as may be expressly provided in the LEA Terms.

J. Termination

Without prejudice to any other of its rights, C3P may terminate the LEA Terms, without notice to you, if you fail to comply with the terms herein. If the LEA Terms are terminated, you will no longer have access to the LEA Website and you will return or permanently delete all information in your possession relating to the LEA Website and all copies thereof. The terms herein will survive the termination or expiry of the LEA Terms.

K. Linked Sites

C3P may provide links to other websites which are provided for your convenience. C3P does not endorse or take responsibility for the accuracy or appropriateness of the information, data, opinions, advice, statements, content, hyper-links, and information contained on those websites and is not liable for any issues arising from your using those websites. Access to linked websites is at your own risk. In providing links to the other websites, C3P is in no way acting as a publisher or disseminator of the material contained on those other websites and does not seek to monitor or control such websites. A link to another website should not be construed to mean that C3P is affiliated or associated with same. The mention of another party or its product or service on the LEA Website should not be construed as an endorsement of that party or its product or service.

L. General Provisions

The LEA Terms cannot be assigned or transferred, in whole or in part, by you. The LEA Terms will endure to the benefit of and be binding upon each of us and our respective heirs, successors, and permitted assigns. The LEA Terms will be governed by, and construed under, the laws of the Province of Manitoba and parties irrevocably attorn to the exclusive jurisdiction of the Manitoba court. C3P expressly excludes the UN Convention on Contracts for the International Sale of Goods and The Sale of Goods Act (Manitoba), as amended, replaced, or re-enacted from time to time. The LEA Website, and these terms and conditions of use, are made available in both French and in English and each are equally valid. For English speakers, each party agrees that this Agreement be drawn-up in English, and for French speakers each party agrees that this Agreement be drawn-up in French. In the event that any provision of the LEA Terms is held by a court or a tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portion of the Terms will remain in full force and effect.

Agreement to Terms

The LEA Terms are effective upon clicking “Yes, I agree” and remain in effect until terminated by either party. By clicking “Yes, I agree” you:

  • signify your personal agreement, and the agreement of your employer, to accept the LEA Terms electronically and have the electronic version having the same legal effect as an original written document; and,
  • represent and warrant that you are employed by a law enforcement agency within Canada and are authorized to accept the LEA Terms on behalf of your employer. The term “employer” means the entity that employs you.
